Users are responsible for keeping their access credentials confidential.Deletion and termination of User accountsRegistered Users may deactivate their accounts, request their deletion or discontinue using the Service at any time through the Giratine interface or by contacting the Owner directly. The Owner, in the event of any violation of these Terms, reserves the right to suspend or terminate the User's account at any time and without notice.PurchasePurchase procedureEach order submitted constitutes an offer to purchase products. Orders are subject to availability and the discretionary acceptance of the Owner. The User must select the products and carry out the check-out, after carefully checking and, if necessary, modifying the information contained in the order summary. The order is placed by confirming the order and is subject to the payment of the price, taxes, shipping and payment costs indicated in the order summary form. In order to exercise the right of withdrawal, the User must inform the Data Controller of the decision to withdraw by means of an explicit declaration sent to the contacts indicated.Effects of withdrawalIf the User withdraws from this agreement, he will be reimbursed for all payments he has made to the Holder, including delivery costs without undue delay and in any event no later than 14 days after the day on which the Holder is informed of the User's decision to withdraw from this agreement. Such refunds shall be made using the same means of payment as was used by the User for the initial transaction, unless the User has expressly agreed otherwise; in any event the User shall not incur any costs as a result of such refund. The right of withdrawal does not apply to: goods made to measure or clearly personalised or which, by their nature, are liable to deteriorate rapidly, are sealed and are not suitable to be returned for hygienic reasons or are related to the protection of health and have been opened after delivery.WarrantyConsumers are entitled to a warranty on the conformity of the products and services purchased. The guarantee lasts for 6 months from delivery of the goods and the lack of conformity must be notified to the Owner within 2 months of its discovery. In order to exercise the right to a guarantee, the User must send an e-mail to the Controller, indicating the order number and an accurate description of the defect (we recommend that you also attach photographic material). All the elements are essential and will be verified by the Controller before giving a reply to the User. In the event that the product is found to be defective, the User has the right to have it repaired or replaced after returning the defective product to the Controller. The user also has the right to demand an appropriate reduction in the price or termination of the contract from the contractor if repair or replacement is impossible or excessively expensive, if the contractor has not repaired or replaced the product within a reasonable period of time or if the previous repair or replacement has caused significant inconvenience to the user. In order to exercise the right of guarantee and for further information, the User should contact the Controller.Discontinuation of the ServiceThe Owner reserves the right to add, remove functionality or features or suspend or discontinue altogether the provision of the Service, either temporarily or permanently. In the event of permanent interruption, the Owner will act as far as possible to allow Users to retrieve their information hosted by the Owner.Resale of the ServiceUsers are not permitted to reproduce, duplicate, copy, sell, resell or exploit any portion of Giratine and its Services without the express permission of the Owner, granted either directly or through a specific resale program.IndemnityThe User agrees to indemnify the Owner (as well as its administrators and employees) against any obligation or liability, including any legal fees incurred in defending itself in court, which may arise from damage caused to other Users or third parties, in relation to content uploaded online, violation of the terms of law or the terms of these terms of service.Prohibited useThe Service shall be used in accordance with the Terms. Users may not:- reverse engineer, decompile, disassemble, modify or create derivative works based on Giratine or any portion thereof;- circumvent the computer systems used by Giratine or its licensors to protect the content accessible through it;- copy, store, modify, change, prepare derivative works from, or alter in any way any of the content provided by Giratine;- use any robot, spider, search and/or site finding application, or any other automated device, process or means to access, retrieve, scrap or index any portion of Giratine or its content;- rent, license or sublicense Giratine;- defame, abuse, harass, stalk, threaten or otherwise violate the rights (such as rights of privacy and publicity) of others;- disseminate or post content that is unlawful, obscene, infringing, defamatory or inappropriate;- use Giratine in any other manner that violates these Terms.Privacy policyFor information on the use of personal data, Users should refer to Giratine's Privacy Policy.Intellectual property rightsAll of the Application's trademarks, whether figurative or nominative, and all other signs, trade names, service marks, word marks, trade names, illustrations, images, logos appearing in connection with Giratine are and remain the exclusive property of the Owner and are protected by current trademark laws and relevant international treaties.Age requirementsUsers declare that they are of legal age according to the legislation applicable to them. Minors may only use Giratine with the assistance of a parent or guardian. Under no circumstances may children under the age of 13 use Giratine.Limitation of liabilityThe Owner, within the limits of the applicable law, is liable for damages of a contractual and non-contractual nature to Users or third parties exclusively when these constitute an immediate and direct consequence, due to malice or gross negligence, of the activity of Giratine. The User expressly exempts and releases the Owner from any liability, to the extent permitted by applicable law, in relation to any damages or claims of any kind and nature of its own and/or third parties including direct, indirect, punitive, incidental, special damages, damages resulting from loss of profits, loss of revenue, loss of data or replacement costs arising out of or in any way connected with this agreement.Changes to these TermsThe Owner reserves the right to make changes to the Terms at any time, giving notice to the User by posting it within Giratine. Any User who continues to use Giratine after the publication of the changes accepts the new Terms without reservation.AssignmentThe Owner reserves the right to transfer, assign, dispose of by novation or subcontract all or any of its rights or obligations under the Terms, provided that the User's rights hereunder are not affected. The User shall not assign or transfer in any way its rights or obligations under the Terms without the written consent of the Owner.CommunicationsAll communications relating to Giratine must be sent using the contact information indicated in the Contract.Ineffectiveness and partial nullityIf any provision of the Terms is found to be void, invalid or ineffective, that provision shall be deleted and the remaining provisions shall not be affected thereby and shall remain in full force and effect.Applicable law and competent courtThese Terms and all disputes relating to the performance, interpretation and validity of this agreement shall be subject to the law, to the jurisdiction of the State and to the exclusive competence of the court of the place where the Holder is established.
